There were 2 different speed models made by Honda, the slower one is 99.9% painted red from factory and is only rated at 20mph. The yellow one with white accessories is the faster one and can be modified to go in the 40's pretty easily.

Dead Battery?

This is usually a dead battery. There may be enough juice to close the relay but not enough to turn the crank.

The Puch's that MySpree is refering to are usually European and would be classified as Motorcycles in the US. Yes, the normal DMV requirement to be classified as a Moped in most states is that they are 2hp or less, under 50cc, and maximum speed is 30mph. Some states require pedal power in addition to the motor, hence, "Mo-Ped", and all the rest, (scooters) are grouped in a small motorcycle class. ...
