I've always wondered the same, everyone talks about them caring about motor size, but I doubt some cop will pull apart your motor and measure everything with calipers, then calculate displacement.
I do know of a few people the have gotten speeding tickets on modded peds, and they got to ride home afterwards (with a ticket, of course). My uncle even got ticketed on a bone stock jog, so it's not like speeding automatically means it's a modded motor.

Unless your state, city or whatever has a Constitution violating law that skips due process only the court can confiscate it. The cops can hold it for evidence but * it is a piddly * misdemeanor at most and shouldn't be turned into a federal case. Then again you might need a lawyer that knows the law to stop the jack booted thugs. Cops violate the law all the time, mainly because they THINK they know the law when in all reality they don't no jack. I never heard of anyone confiscating a scooter for any reason here.

A motorcycle license won't make a difference, the laws are concerning overall speed, not whether you have a license or not.
And you need something motorcycle sized bike (not a moped) to take the test, if you use a big scooter there is a "belt driven" restriction which says you can't ride anything with a clutch.

plus you gotta be atleast 15 yrs old...If i ever decide I want a bigger engine displacement I just need to get a motorcycle license...
